The San Diego Superior Court certified the lawsuit Kimberley Card, an individual and on behalf of all others similarly situated, as plaintiff Vs. Party City Corporation, a Delaware Corporation and Worthington Cylinder Corporation, an Ohio Corporation, defendants, a class action lawsuit and issued a notice in order to notify those affected by this class action.
What Is a Class Action?
A class action lawsuit refers to a lawsuit in which not an individual, but a group of individuals harmed by the same action sue the defendant or defendants.
When the court permits a class action the group of individuals will sue the defendant through a representative often labeled as the “lead plaintiff”. When a class action is won by the defendant the plaintiff group is dismissed and the individuals from that group are not allowed to pursue justice in this case individually again. If the class wins the award is divided between the members of the class action group.
The Worthington Balloon time Class Action Case

“ IF YOU PURCHASED A BALLOON TIME BRAND HELIUM TANK KIT PRODUCT THAT WAS LABELED AS “MADE IN USA” OR “MADE IN THE USA” FROM NOVEMBER 6, 2008 TO MAY 31, 2012,YOUR LEGAL RIGHTS ARE AFFECTED WHETHER YOU ACT OR DON’T ACT. PLEASE READ THIS NOTICE CAREFULLY. THE CLASS DEFINITION DOES NOT EXTEND TO ONLINE PURCHASES.”
